General Terms and Conditions of Contract

Holiday Home Finca Alzinar Arta, Mallorca

This website is intended for the rental of the holiday home Finca Alzinar Arta. The rental is agreed between private individuals, namely, between the tenant and the owner.

The owner of the house is Jochen Strunk, Ado 18, 07570 Artà.

The Rental Contract:

The fixed-term rental contract for the holiday home is concluded between you as the tenant and the owner of the house. The object of the contract is the temporary use of the holiday home for residential purposes.

1. Conclusion of the Contract

1.1. With the written booking confirmation (not the booking request), the client (tenant) submits a binding offer to the owner or their representative to conclude a contract. The owner confirms all relevant booking information (arrival and departure dates, number of people, price). For short-term bookings, telephone confirmations can also be accepted, which will be confirmed in writing after arrival.

1.2. Until the start of the holiday stay, the tenant may request that another person assume the rights and obligations of the holiday home contract in their place. The owner may object to the third party's entry if they do not meet the specific requirements for staying in a holiday home or if legal provisions prohibit it. If a third party enters into the holiday home contract, both they and the tenant are jointly liable to the owner for the rental price.

2. Payment

2.1. The down payment is usually 20% of the rental price and is due upon receipt of the booking confirmation/invoice. It must be received within 10 days of the date of the booking confirmation/invoice by the owner. The remaining payment is generally due 8 weeks before the rental start date. Special arrangements must be confirmed in writing (by email). Failure to make payments as per the contract may be considered a withdrawal by the tenant, as outlined in Section 5, and the amounts specified there will become due.

2.2. Agreed additional costs (e.g., bike rental, shopping service) must be paid on-site.

2.3. Rental prices are usually quoted as daily rates in euros.

2.4. Prices and service descriptions are subject to change and typographical errors. The prices published on the website at https://www.ferienhaus-alzinar-arta.de are valid.

3. The Rented Holiday Home

3.1. The rental property is owned by the aforementioned owner. Regarding description, equipment, and cleanliness, the owner assumes responsibility to the extent possible with the constant arrival of new tenants.

3.2. The holiday home must not be occupied by more people than indicated in the description. Short-term occupancy with additional people must be agreed upon with the owner; otherwise, the owner may refuse the additional persons.

3.3. The minimum rental period in summer is usually 7 nights. Shorter stays are possible if there are fewer than 7 nights available between existing bookings. Check-in is from 5 p.m. or by arrangement, and check-out is by 10 a.m. or by arrangement.

3.4. If the tenant does not arrive on the check-in day and does not notify the owner or their representative within 48 hours, the contract will be considered canceled. The owner may then freely dispose of the property.

3.5. The use of tents or caravans on the property is prohibited. The tenant is responsible for keeping the property clean; additional cleaning services can be arranged for a fee. Upon departure, the property must be left clean. Final cleaning is carried out by the owner’s staff on-site, and the fee (if applicable) is specified in the house description and booking confirmation.

3.6. Pets are only allowed with the written consent of the owner. The breed and number of animals must be specified. If undeclared pets are found, the rental agreement is terminated immediately without compensation.

3.7. The scope of services for the rental property is determined solely by the service description on the website. Additional agreements must be confirmed in writing by the owner.

3.8. Bed linen and towels are provided by the owner.

3.9. Complaints must be reported to the owner immediately or within 24 hours after arrival at the holiday location. The owner is committed to resolving issues within a reasonable period. Late complaints will not be accepted.

3.10. The absence of insects, wasps, ants, etc., cannot be guaranteed.

3.11. The owner assumes no liability for the tenant, their companions, or their property. No responsibility is taken for the loss of valuables (especially jewelry, money, etc.).

3.12. The house is located in a rural area; special precautions are required, especially in summer (no barbecues due to fire risk, care with pets due to nearby wildlife).

4. Changes to Services

Images in the catalog (website) are non-binding. Furnishings and equipment may vary but are generally equivalent to the examples provided.

5. Withdrawal by the Tenant

The tenant may withdraw from the contract at any time or present a substitute tenant. Withdrawal or substitute tenant notification becomes valid upon receipt by the owner. Written notifications (letter, email) are recommended. Cancellations made at least 8 weeks before the rental start date are free of charge. In this case, prepayments will be refunded.

6. Unused Services

If the tenant does not use the services, there is no entitlement to a partial refund.

7. Withdrawal by the Owner

If the rental of the holiday home is impossible, the owner will try to offer a replacement property. Otherwise, payments will be refunded without further claims for compensation.

8. Final Provisions

The invalidity of individual clauses does not affect the validity of the contract as a whole.
